3. How we use your information

We do not use your coaching conversations to train AI models. We do not sell or share your data with third parties for marketing purposes.

4. AI and conversation processing

Helpz uses AI technology powered by Anthropic (Claude) to generate coaching responses. When you send a message, it is processed by Anthropic's API. Anthropic's privacy policy applies to this processing and can be found at anthropic.com/privacy.

Conversations are used solely to generate coaching responses. They are not used to train AI models, and are not shared with third parties beyond what is necessary to provide the service.

Your conversations are private. We treat them with the same care we would want applied to our own personal communications.

5. Data sharing

6a. Security

We use industry-standard security measures to protect your personal data, including encrypted data transmission (HTTPS), secure password hashing, and access controls on our databases. We do not store full payment card details — all billing is handled by Stripe, a PCI-compliant payment processor.

In the event of a data breach that affects your personal information, we will notify affected users within 72 hours of becoming aware of the breach, where required by applicable law.

3. Your account

4. Subscription and billing

Free trial

New accounts receive a 7-day free trial with full access to Helpz features. No credit card is required to start. At the end of the trial period, continued access requires a paid subscription.

Helpz does not provide prorated or partial refunds prior to the renewal period.

5. Acceptable use

You agree not to use Helpz to:

Important: Helpz is an AI coaching service, not a confidential therapy or legal service. Content that suggests imminent harm to yourself or others, or that indicates criminal activity, may be reviewed and reported to appropriate authorities where required by law. By using this service you acknowledge and consent to this. We reserve the right to immediately terminate any account that violates these terms and to cooperate fully with law enforcement.

We reserve the right to suspend or terminate accounts that violate these terms without notice and without refund.

6. Content and intellectual property

All content, design, code and materials on Helpz are owned by us or our licensors. You may not copy, reproduce or distribute any part of the service without our written permission.

Content you create within the app (your messages, goals, wins) remains yours. By using the service you grant us a limited license to process this content to provide the coaching service.

7. AI coaching — important disclaimer

Coaching responses are generated by AI and are for general productivity and wellbeing support only. They do not constitute medical, psychological, legal or financial advice.

8. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access to the service. We may perform maintenance, updates or experience outages from time to time. We will notify users of planned downtime where possible.

9. Limitation of liability

To the maximum extent permitted by law, Helpz is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental or consequential damages arising from your use of the service.

Our total liability to you for any claim arising from your use of Helpz shall not exceed the amount you paid us in the 12 months preceding the claim.

AI Coaching Limitations: Helpz provides AI-generated coaching support only. The service is not a substitute for licensed mental health treatment, medical care, legal counsel, or crisis intervention. We make no representations that the AI coaching will be suitable for your individual circumstances, produce any specific outcome, or be free from error. Use of this service is entirely at your own risk.

No Liability for User Content: Helpz is not responsible for content submitted by users. We are not liable for any harm resulting from content posted, shared, or communicated through the service by any user. Pursuant to Section 230 of the Communications Decency Act (and equivalent legislation in applicable jurisdictions), Helpz is not the publisher or speaker of user-generated content and shall not be held liable for such content.

No Liability for Third-Party Actions: We are not liable for any actions taken by law enforcement or other authorities as a result of content you submit to the service, including content that is reported pursuant to our legal obligations.

Indemnification: You agree to indemnify, defend, and hold harmless Helpz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

9a. Prohibited content — threats, hate speech and illegal activity

Zero Tolerance Policy: Helpz has zero tolerance for threats of violence, hate speech, content involving the exploitation of minors, or any content that facilitates criminal activity. Violations will result in immediate account termination and may be reported to law enforcement.

Our AI coaching system is designed to redirect conversations involving crisis, anger, or distress toward constructive support. However, the AI is not a law enforcement tool and cannot guarantee detection of all harmful content. Users are solely responsible for the content they submit.

If you become aware of content on Helpz that involves a credible threat of harm or illegal activity, please report it immediately to helpz.com/support.

Abuse disclosures: If you disclose ongoing abuse (physical, emotional, or sexual) to yourself or another person through the platform, our AI coach is designed to provide supportive responses and direct you to appropriate resources. Helpz does not proactively report such disclosures to authorities, but we encourage you to contact emergency services (911) or the National Domestic Violence Hotline (1-800-799-7233) if you are in danger.

Helpz cooperates fully with law enforcement requests and legal processes. We reserve the right to disclose user information and conversation content to authorities where required by law or where we reasonably believe disclosure is necessary to prevent harm.

10. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these terms or if we discontinue the service, with reasonable notice where possible.

Upon account deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.

11. Changes to terms

We may update these terms from time to time. We will notify you of significant changes by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute resolution: In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States.

Class action waiver: You agree that any dispute will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exception: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

12a. Reporting obligations

Helpz is an AI coaching platform, not a licensed clinical or therapeutic service, and is not a mandatory reporter under state mental health or child protection statutes. We are not obligated to proactively report user conversations to authorities.

However, we will cooperate fully with valid law enforcement requests and legal processes. We reserve the right — but not the obligation — to report content to appropriate authorities where we reasonably believe there is an imminent risk of serious harm to any person.

CSAM exception: Federal law (18 U.S.C. § 2258A) requires us to report any apparent violations involving child sexual abuse material (CSAM) to the National Center for Missing and Exploited Children (NCMEC). This is a non-negotiable legal obligation that applies regardless of platform type.

You are solely responsible for the content you submit. We are not liable for any actions taken by authorities as a result of content you submit.
